In her article, “NCDR in 2026: The New Centre of Gravity in HNW Divorce”, Xanthy examines the increasingly central role of non court dispute resolution in high-value financial remedy cases. She explores how, particularly for high-net-worth and ultra-high-net-worth clients, the focus has shifted from whether to engage in NCDR to how early and how strategically these processes should be deployed. NCDR includes all forms of non-court dispute resolution, including mediation, arbitration, private FDR, Early Neutral Evaluation, round table meetings, etc.
The article considers the practical drivers behind this change, including ongoing court delays and the evolving judicial expectation that parties engage in alternative forms of dispute resolution. It also highlights why NCDR aligns so closely with the needs of HNW clients, offering greater flexibility, confidentiality, and control over both process and outcome.
